Injured in a Brake Failure Accident? Call (888) 801-9916
Brake failure is a leading vehicle-related cause of motor vehicle accidents, particularly because brake-related violations are very common in the United States. For example, in honor of Brake Safety Day 2021, a total of 8,658 brake inspections were conducted in the U.S. Out of the vehicles inspected, 1,273 were put out of service over brake violations.
If you were injured in a trucking accident due to brake failure, Shaheen & Gordon, P.A. will fight for your compensation. Our trial lawyers know and understand trucking industry regulations, which helps us identify violations like defective or faulty brakes.

Brake Failure in Truck Accidents
The most common types of brake failure are caused by either defective brakes or poor brake maintenance. Driver error may also lead to brake failure, however.
Defective Brakes
A brake is considered defective when any part of the braking system does not work properly because of a manufacturing or design defect. This may mean that the design of the brake itself prevents it from stopping the truck as it should. It may also mean that a well-designed brake was ruined during the manufacturing process. Defective brake cylinders (where the brake fluid is compressed) and defective brake boosters (the part of the brake that amplifies the pressure you apply on it) are two common examples.
Poor Brake Maintenance
Poor brake maintenance simply means that the owner of the truck, typically a trucking company, failed to maintain the brake system. This may happen as a result of improper brake maintenance or a lack of regular brake maintenance. A few examples include poorly adjusted brakes, worn components, overheated brakes, and low levels of brake fluid.
Is the Truck Driver Responsible for Brake Failures?
In most cases, truck drivers are not responsible for defective or poorly maintained brakes. However, they may be to blame if they failed to follow certain regulations, thereby rendering their brakes ineffective. One example of this is when a truck driver speeds on city streets, leaving the truck without enough time to stop or turn safely.
