Guardianship, for adults, is the court process by which a court finds a person (known as the ward) to be mentally incapacitated and appoints a guardian to make decisions for the ward.

New Hampshire has two types of guardianship. A guardian of the person has authority to make decisions over the ward’s living arrangements and health care. A guardian of the estate has authority to manage the ward’s finances.

Durable powers of attorney for health care and finances usually make guardianship unnecessary, avoiding what can be a time-consuming and expensive court process. However, for individuals who have not prepared such documents in advance of becoming incapacitated, guardianship may be the only alternative.
