Do I Have a Case?
You likely have a case if the other driver’s negligence led to the crash. This may include:
- Speeding
- Tailgating
- Ignoring traffic signals
- Drunk/intoxicated driving
- Drowsy/fatigued driving
- Failing to check their blind spot
- Texting and driving or other types of distracted driving
When Should I Hire a Car Accident Lawyer?
Although most cases begin with a suspicion, it is not enough to only suspect the other driver of negligence. You will need to prove it to recover any compensation. This even applies to accident victims who plan to settle their case far before a formal lawsuit is filed. The insurance company simply will not compensate you if you cannot prove negligence. Worse, the other party may attempt to falsely blame you for the crash.
No matter whether the accident was minor or severe, it never hurts to consult a lawyer. Doing so can protect your right to take legal action, increase your chances of success, and maximize your compensation. You may find that your case is worth more than insurance has led you to believe.
For example, you may be compensated for:
- Hospital bills
- Medication costs
- Disability accommodations
- Vehicle repairs
- Lost wages
- Reduced future earning potential
- Pain and suffering
At Shaheen & Gordon, P.A., we offer free consultations with no strings attached. This way, you can consult an experienced attorney without feeling pressured to move forward. We aim to help clients move on, not bog them down with unnecessary stress.
What Happens if Both Drivers Are at Fault in an Accident?
If both drivers are considered at fault for a crash, the court will assign percentages of liability. If you are found to be less than 51% at fault, then you may recover compensation. The catch is that you cannot collect damages for your percentage of fault.
So should an accident result in $100,000 in damages, a plaintiff 10% at fault will not be entitled to 10% of this amount. They will only be able to collect the remaining $90,000.
