Possession of any amount of marijuana remains illegal in New Hampshire even though small amounts are no longer considered a crime pursuant to N.H. Rev. Stat. Ann. §318-B:26, the statute that criminalizes the possession, possession with intent to sell, cultivation, manufacturing, sales, distribution, and trafficking of any controlled substance.
Possessing less than three-fourths of an ounce of marijuana in New Hampshire is a violation offense, resulting in a fine of up to $100 for the first or second offense. Possession of more than three-fourths of an ounce is considered a Class A Misdemeanor and a crime, resulting in up to a year in prison and a fine of up to $350.
However, certain marijuana offenses result in felony charges. The felony penalties for marijuana cultivation, sales, or possession with intent to sell are as follows:
- 5 pounds or more: Up to 20 years in prison; maximum fine of $300,000; or both
- 1 ounce or more: Up to seven years in prison; maximum fine of $100,000; or both
- Less than 1 ounce: Up to three years in prison; maximum fine of $25,000; or both
