Workers compensation is a mandatory system that makes employers responsible for the care of injured workers. In exchange, employers are given immunity from personal injury lawsuits by their employees.

All employers are required to provide workers’ compensation to restore or replace the earning capacity of injured workers. It provides wage replacement during periods of disability, and covers medical costs for job-related injuries and illnesses. Still, injured workers can face challenges when pursuing workers’ compensation benefits, and a Concord workers’ compensation lawyer from Shaheen & Gordon, P.A. can help.

Our Concord attorneys know New Hampshire’s workers’ compensation laws and procedures and are ready to fight for your right to collect benefits if you have sustained an on-the-job injury or condition. Request a free consultation with us and learn more about how we can help you today.

We handle all types of workers’ compensation cases

The first thing to do after sustaining an injury at work or discovering a work-related illness is to get medical attention and then report the accident or condition to your supervisor. Of course, if you need emergency care, make the report as soon as possible after getting treated. Then, connect with a Concord workers’ compensation attorney from our team.

Our team can manage all the legalities of your case. We will also fight to get you the compensation amount you deserve. You can depend on Shaheen & Gordon to do the following:

  • Collect evidence supporting your claim: Medical records, witness statements, input from experts, accident reports, and other sources may provide valuable information. We will leave no source of evidence untapped.
  • File your claim on time: The New Hampshire Department of Labor (DOL) provides a timeline for filing workers’ compensation claims. By connecting with our team promptly after being injured or discovering an illness, we can act within the State’s deadlines.
  • Handle communication and negotiation with the insurance company: Insurance companies often deny your claim, challenge aspects of your medical care or try to reduce your benefits. We will speak with the insurance company and other involved parties on your behalf, demanding their accountability and protecting you from inadvertently saying something that could be used to damage your claim.
  • Appeal claim denials: Not all workers’ compensation claims are approved right away. If yours is denied, do not lose hope. We can manage the appeal of your workers’ compensation denial.

Types of workers’ compensation injuries and illness

Unfortunately, there is no limit to the kinds of workplace accidents that can lead to injury. Construction and industrial jobs come with high risk as workers perform intense physical labor and work with heavy equipment and powerful machines. Yet, even employees in less physically demanding settings face risks of falls on slippery floors or dangerous staircases, exposure to toxic substances if they work with cleaning supplies or in old buildings, and other unexpected mishaps.

Injuries and illness prompting a workers’ compensation claim include, among others:

  • Back injuries
  • Auto accidents while traveling for work
  • Burns from fires, explosions, electrocution, or exposure to chemicals
  • Disfigurement
  • Broken bones
  • Head or brain trauma
  • Deep lacerations or amputations
  • Loss of sight from chemical injuries or loss of hearing from constant exposure to noise
  • Carpal tunnel syndrome or other conditions caused by repetitive movement or strain
  • Asthma or other respiratory conditions caused by poor air quality or environmental toxins
  • Mesothelioma from asbestos exposure

Work-related fatalities

Sadly, some victims die from their on-the-job injuries or work-related conditions. Statistics from the U.S. Bureau of Labor report 21 fatalities in New Hampshire over a recent year and 19 from the year prior. As per New Hampshire law, surviving family members can collect workers’ compensation death benefits

According to the New Hampshire DOL, eligible dependents can receive “weekly compensation…of a deceased worker if the fatality occurred as a result of an injury arising out of and in the course of employment.” Benefits also include up to $10,000 for burial costs. If your loved one dies from a work injury, the compassionate, experienced Concord workers’ comp lawyers from Shaheen & Gordon can help you through the devastating aftermath and fight for maximum death benefits.

What to know about the New Hampshire workers’ compensation system

Workers’ compensation benefits provide injured workers and their families with critical injured employee benefits during an uncertain time. Benefits include:

  • Weekly payments representing 60% of your average weekly wages.
  • Unlimited coverage for medical, hospital, and rehabilitative care, including the cost of transportation to appointments.
  • Vocational training and job-finding costs. You may need to pursue a new occupation if injuries prevent you from returning to your previous job.
  • Temporary partial disability payments if you can return to work but in a diminished capacity and therefore cannot earn as much. These payments help cover the difference in wages.
  • Permanent impairment awards if you sustain a permanent loss of or use of a “compensable body part”.

New Hampshire’s laws allow for additional compensation in applicable cases, and you can trust your Concord workers’ compensation attorney to pursue all possible benefits.

We have the experience to handle your unique case

No two workers’ compensation cases are the same, but some law firms do not take the time to build individual case strategies and rely on a “standard” approach. Shaheen & Gordon is a different kind of workers’ comp firm. We will treat your case as the unique situation it is, designing a strategy that will work best for you, treating you with respect and kindness throughout the legal journey.

We offer free case consultations, so there is no risk in reaching out. Call us at (800) 451-1002 or connect with us online. We are here for you.

Answers to frequently asked workers’ compensation questions

Do all employers carry workers’ compensation insurance?

New Hampshire’s workers’ compensation law, RSA 281-A:5, requires any employer with full or part-time employees to either purchase workers’ compensation insurance and benefits to cover workers injured on the job, or pay those same benefits themselves.  There is no opt-out of the workers’ compensation system.

What if I am partially to blame for my injury?

Workers’ compensation is a no-fault system that covers workplace injuries regardless of who bears fault. Typically, any employee, whether part-time, full-time, or temporary, can secure benefits. Benefits also apply to immigrant workers and, in most cases, undocumented workers.

What if my workers’ compensation has been denied?

Do not give up on your pursuit even if your claim has been denied. A workers’ compensation attorney from our team can review your case to find grounds for an appeal. We can help you challenge the denial by requesting a hearing before the Department of Labor.

Why should I partner with a workers’ compensation lawyer?

If your claim or some aspect of it has been denied, the only way to challenge it is to present your case at a hearing before the NH Labor Department.  A workers’ compensation attorney knows workers’ compensation laws, understands your rights, and has experience working through the workers’ compensation process. We know the kinds of evidence and documentation needed to present a convincing claim.

Should you face challenges from your employer or the insurance company or have your claim denied, we can help you through those challenges. Our team will fight for every benefit you are entitled to and provide support and guidance as your case moves toward a resolution.

I would like to thank the Law Firm of Shaheen and Gordon, specifically Attorney O’Connor and Paralegal Chilton. They were both extremely professional and very personable. They went out of their way to contact me during the recent holidays when they were supposed to be off. The communication between everyone was flawless and they made a difficult time easier for me and my family. They were literally there for us anytime we had a question and were able to walk us through our case by explaining everything in an easy manner to understand.
