Our immigration team has witnessed firsthand the challenges immigrants face navigating the complexities of the legal system while striving to build a stable life for themselves and their families. The recent implementation of the Work and Family Mobility Act (WFMA) in Massachusetts, effective July 2023, marks a significant milestone in ongoing efforts to support and integrate immigrant communities.

What is the Work and Family Mobility Act?

The Work and Family Mobility Act allows eligible residents in Massachusetts to obtain a Standard (Class D or M) driver's license regardless of their immigration status. This groundbreaking legislation removes the previously mandatory requirement for customers to provide proof of lawful presence to acquire a standard driver’s license.

Why is this Important?

The implementation of the Work and Family Mobility Act is a significant development that carries profound implications for both public safety and the well-being of immigrant communities in Massachusetts. One of the key benefits of this legislation is enhancing road safety. By allowing undocumented immigrants to obtain driver's licenses, the law ensures that more drivers on the road are properly tested, licensed, and insured. This reduces the likelihood of accidents and promotes greater accountability among all drivers.

Moreover, the Act plays a crucial role in promoting economic stability. For many immigrants, the ability to drive legally opens up new employment opportunities, enabling them to commute to work, attend job interviews, and access other essential services. Reliable transportation is often a determining factor in securing and maintaining employment, and the WFMA helps to remove barriers that previously hindered economic advancement for undocumented individuals.

Beyond safety and economic benefits, the WFMA also facilitates social integration. A driver’s license is not just a permit to drive; it serves as a vital form of identification that grants access to a wide range of services and opportunities. By making driver’s licenses available to all residents, regardless of immigration status, the Act fosters a sense of inclusion and belonging, allowing immigrants to more fully participate in their communities. This integration is essential for building stronger, more cohesive communities where all residents can thrive.

What is the Process for Immigrants to Obtain their Massachusetts Driver’s License?

Here are the steps for immigrants seeking to obtain a Massachusetts driver’s license from the RMV (Registry of Motor Vehicles) under this new law:

  1. Apply for Your Learner’s Permit and Pay Fees: This requires scheduling an appointment with the RMV and taking the learner's permit exam. You'll want to study and prepare all your documents for your application in advance. You can find resources, including a practice exam, here. You can pay all fees in advance online:
    • Learner’s permit fee is $30
    • Road test fee is $35
    • License fee is $50
  1. Practice Driving and Schedule Your Road Test: Those under 18 must have a permit for six months and complete additional driver’s education before scheduling their road test. Those over 18 may schedule their road test immediately.
  1. Pass Your Road Test: Once you pass your test (and have paid the license fee) you’ll receive a temporary license, and your official one will be sent to your mailing address on file. If you fail your test, you can try again after two weeks. However, you are not allowed to attempt more than six times a year.

You can find additional information on the process for obtaining a license here.
