Congratulations to Attorney Jim Rosenberg and the entire Shaheen & Gordon, P.A. criminal defense team for their jury trial victory in a case involving a young man falsely accused of raping a teen and tampering with a witness. After a three-day trial, the defendant was found not guilty of all felony offenses, including aggravated felonious sexual assault and witness tampering.
The defendant, a Freshman at the University of New Hampshire, was accused of rape arising out of a dorm room party and then asking a friend to lie for him. He faced up to 20 years in prison for the sexual assault charge and up to seven additional years in prison for each witness tampering charge. He was found guilty of a lesser non-registration Misdemeanor due to the age of the alleged victim.
According to Jim Rosenberg, who defended the case, the client was heartened by the jury’s verdict, appreciative of their service during the trial and optimistic about his future in light of the outcome of the case.
“The fact of the matter is, the state charged him with aggravated felonious sexual assault, which is a rape charge, and a jury unanimously found him not guilty,” Rosenberg said. “That means he avoids a felony offense. That means he avoids a registration obligation, and for good reason — there was no aggravated felonious sexual assault that occurred in this case.”
